Jury Awards $893,684 Over Birth Injury

The Janesville (WI) Gazette reports $893,684 has been awarded to parents of a baby boy who suffered permanent injury to his shoulder during his birth in 2001.

The parents sued Janesville's Mercy Hospital, Mercy Women's Health Center, Mercy Clinic West and two doctors, claiming they were negligent in the way they handled the mother's labor and the birth of her son.

Among other things, the lawsuit alleged the doctors should have advised the parents of the risks of a vaginal delivery and that it could be hazardous to the infant. The lawsuit alleges the doctors did not properly dislodge the baby's shoulder when got stuck during delivery, causing the nerves to stretch, causing permanent damage. The boy, now 8-years-old, has limited strength, dexterity and motion in his shoulder.

$49 Million Awarded In California Personal Injury Lawsuit

One of the country's largest personal injury verdicts was awarded to a former college student who is permanently brain damaged after a 2007 automobile accident, reports the Mercury News. The Santa Clara jury found two truckers and state transportation officials at fault in the accident.

On May 3, 2007, the victim was in the back seat of a car heading for a camping trip with three other men when two trucks collided, sending one into the rear of the men's car. The accident left the 23-year-old college student with permanent brain damage requiring full-time care at a neurological treatment center.

Out of court settlements will bring the total damages to more than $60 million, which will be used for the man's care and rehabilitation.

$3.7 Million Awarded To Family After Farm Worker's Death

The Green Bay Press Gazette reports a Brown County, Wisconsin jury has awarded the family of a farm worker $3.7 million in their medical malpractice lawsuit.

The worker died after contracting a fungal infection called blastomycosis. On two separate occasions in December of 2003 the man sought medical treatment at the Bellin Family Medical Facility. The physician assistants misdiagnosed him as having pneumonia without running basic diagnostic tests, including x-rays. In late December, he was admitted to another hospital where he was correctly diagnosed, but it was too late to save his life.

The jury found Bellin Health System and Dr. Peri Aldrich, who oversees the physician assistants, negligent and awarded his wife and two young children $3.7 million.
