$500,000 Awarded in Personal Injury Assault Case

The Observer-Dispatch of Utica, N.Y. reports a 67-year-old Vietnam War veteran has been awarded $350,000 as a result being beaten by a Utica police officer. Once the attorney fees are added to the earlier jury award of $60,000 for pain and suffering, the total amount would be $500,000.

According to reports, the veteran, who suffers from post-traumatic stress disorder, experienced a mental health episode at St. Elizabeth Medical Center, becoming agitated and belligerent. After the officer had the veteran in handcuffs, he continued to punch and knee him to "gain compliance." The incident left the veteran bruised and bloodied.

After the incident in 2008, the police officer was terminated by the Utica Police Department.

Family of University of Washington Scientist Files Wrongful Death Lawsuit

The family of a 39-year-old scientist at the University of Washington has filed a wrongful death lawsuit against the driver of the vehicle that struck and killed him on February 4, 2009, reports the Ballard News-Tribune.

Kevin Black was struck by a Ford E250 van as he was bicycling to work. The driver attempted a U-turn on a street unable to accommodate it and drove into the bike lane, hitting Black. Black was taken to Harborview Medical Center where he later died.

Black, an avid cyclist, was a molecular researcher at the University. He leaves behind two daughters, ages 13 and 10.

Wrongful Death Lawsuit Filed in Texas I-35 Truck Accident Deaths

The sole survivor of an SUV struck by an 18-wheeler in a construction area of Texas I-35 has filed a wrongful death lawsuit. Named in the suit are her 13-year-old son and her 63-year-old father who both died in the accident which occurred over the 4th of July weekend.

The woman's lawsuit was filed against the truck driver, the driver's company, the construction company, and the Texas Department of Transportation (TXDOT.) Her SUV had slowed down for traffic in a construction zone where the highway narrowed to one lane when they were hit by the tractor trailer.

The lawsuit claims TXDOT did not have adequate safety controls in place which made the accident possible. After spending five days in ICU, the survivor is still recovering from her injuries.

Since the July 4th accident, three more people have been killed by another 18-wheeler in the same construction area.

Failure to Advise Woman of Mammogram Results in $3 Million Settlement

The family of a 47-year-old woman has accepted a $3 million settlement against University Diagnostic Medical Imaging and two Bronx doctors for not notifying her of her mammogram results. Her mammograms showed possible breast cancer.

The technician, who suspected breast cancer during the woman’s routine mammograms in 2001 and 2002, recommended an MRI and sent the results to her doctor, Dr. Karim. The results were never given to the patient and no follow up tests were conducted.

In 2004, when she found a lump in her breast, it was too late. The cancer had spread to both breasts and her liver. She died in March 2007.

Cedars-Sinai To Pay $7.3 Million In Negligence Lawsuit

A $7.3 million award has been returned by a Los Angeles jury in a lawsuit alleging Cedars-Sinai Medical Center was negligent, reports the Enquirer-Herald.

The lawsuit was filed in 2005 by the parents of a baby who was misdiagnosed by doctors at Cedars-Sinai Medical Center. The lawsuit claimed the doctors in the hospital's neonatal intensive care unit failed to quickly diagnose and treat the baby for meningitis. As a result of the delay in treatment, the child suffered irreversible brain damage.

$3.5 Million Awarded in Texas Cancer Misdiagnosis

The Dallas Morning News reports one of the largest awards in Denton County, since tort law reform of 2003, has been awarded to the family of a woman who died from misdiagnosed cancer in 2004. The $3.5 million is expected to be reduced to $1.5 million due to civil law and will be divided between her husband, her two children, and her father.

In October, 2002, the 33-year-old woman was told by Highland Family Medical Center the marble sized lump on her head was a sebaceous cyst. The cyst was removed and was not sent to a lab for testing to confirm that it was a cyst. When the cyst returned a year later, the woman saw another doctor but did not have it removed because she was pregnant. By January, 2004, the cyst had quadrupled in size and was diagnosed as a sarcoma. After vigorous treatment, she died on December 14, 2004, leaving a husband and two small children.

The medical malpractice suit was filed by the woman's husband against the medical center, the doctor, and the physician's assistant who removed the initial cyst.
